By accessing or using Novara.chat ("Service"), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the Service.

Novara.chat is a software-as-a-service (SaaS) platform that enables users to create and deploy AI-powered chatbots on their websites, along with booking and appointment scheduling capabilities. The Service is available via web browser, iOS App Store, and Shopify App Store.

4. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information
  • Keep your account information up to date
  • Maintain the security of your password
  • Accept responsibility for all activities under your account
  • Be at least 18 years of age

5. Subscription and Payment

5.1 Free Trial

New users are eligible for a 7-day free trial on all plans. Payment information is required to begin the trial, but you will not be charged until the trial period ends.

5.2 Billing

After the trial period, you will be billed according to your selected plan (monthly or yearly). Billing occurs automatically at the start of each billing period. All fees are in Euros (EUR).

5.3 Refunds

Subscription fees are non-refundable except:

  • Where required by applicable law (e.g., EU cooling-off period)
  • If the Service experiences significant downtime (more than 48 consecutive hours)
  • At our discretion for exceptional circumstances

To request a refund, contact support@novara.chat within 14 days of the charge.

You may cancel your subscription at any time through your Account Settings or by contacting support. Upon cancellation:

  • Access continues until the end of your current billing period
  • No further charges will be made
  • You can export your data before the subscription ends

5.5 Plan Changes

You can upgrade or downgrade your plan at any time:

  • Upgrades: Take effect immediately with prorated billing
  • Downgrades: Take effect at the end of the current billing period

6. Acceptable Use

You agree not to use the Service to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights of others
  • Transmit harmful, threatening, harassing, or defamatory content
  • Distribute spam, malware, or unauthorized advertising
  • Attempt to gain unauthorized access to systems or data
  • Interfere with or disrupt the Service
  • Collect personal data without proper consent
  • Impersonate others or misrepresent your affiliation
  • Use the Service for illegal activities

We reserve the right to suspend or terminate accounts that violate these terms without refund.

7. Content and Data

7.1 Your Content

You retain ownership of content you upload to train your chatbots. By uploading content, you grant us a non-exclusive license to process and store it for the purpose of providing the Service.

7.2 End User Data

You are responsible for:

  • Obtaining necessary consents from visitors who interact with your chatbot
  • Complying with applicable data protection laws (GDPR, CCPA, etc.)
  • Displaying appropriate privacy notices on your website
  • Handling personal data collected through the Service responsibly

7.3 Content Restrictions

Your chatbot content and responses must not include:

  • Medical, legal, or financial advice presented as professional guidance
  • Content that could harm minors
  • Discriminatory or hateful content
  • Intentionally false or misleading information

8. Account Deletion

You can delete your account at any time through Account Settings. Deletion will:

  • Permanently remove your profile and personal information
  • Delete all chatbots, training data, and conversations
  • Delete all booking systems and appointment data
  • Cancel your subscription

Some data (such as anonymized invoice records) may be retained for legal compliance. For details, see our Privacy Policy.

9. Intellectual Property

The Service, including its original content, features, functionality, software, and branding, is owned by AIBoost365 and protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service without our written permission.

10. Third-Party Services

The Service integrates with third-party providers:

  • OpenAI: Powers chatbot AI responses
  • Stripe: Processes payments
  • Supabase: Provides database and authentication

Your use of these services through Novara.chat is subject to their respective terms and policies.

11. Service Availability

We strive to provide 99.9% uptime but do not guarantee uninterrupted service. Planned maintenance will be announced in advance when possible. We are not liable for:

  • Scheduled maintenance downtime
  • Third-party service outages (hosting, AI providers, etc.)
  • Force majeure events

12. Limitation of Liability

To the maximum extent permitted by law, AIBoost365 and Novara.chat shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, revenue, or data
  • Business interruption
  • Cost of substitute services
  • Unauthorized access to your data

Our total liability for any claims under these terms shall not exceed the amount you paid for the Service in the 12 months prior to the claim.

13. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy of AI responses

We do not warrant that AI-generated chatbot responses will be accurate, complete, or appropriate for any specific use case.

14. Indemnification

You agree to indemnify and hold harmless AIBoost365, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your use of the Service
  • Your violation of these terms
  • Your violation of any third-party rights
  • Content you upload or generate through the Service

15. Governing Law

These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which AIBoost365 operates, without regard to conflict of law provisions.

16. Dispute Resolution

Any disputes arising from these terms or the Service shall first be addressed through good-faith negotiation. If unresolved, disputes may be submitted to binding arbitration or resolved in the courts of the applicable jurisdiction.

17. Changes to Terms

We reserve the right to modify these terms at any time. We will provide notice of material changes by:

  • Email notification to registered users
  • In-app notification
  • Updating the "Last updated" date above

Continued use of the Service after changes take effect constitutes acceptance of the new terms.

18. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
